Question: Who got the ticket? Obviously not the mother since she wasn't even there. So I'm not sure how the driver at fault can avoid responsibility, regardless of what she told the insurance company.

Don't read the following if you don't want to hear a nasty story.
I don't want to turn this into a thread about me because this is Raven's thread. But this all hits so very close to home.
A few years ago, a middle aged woman drove thru a stop sign and in front of me. Having about 1 second to stop, I hit her. Before the police arrived, an ambulance took the woman's son (who was in the passenger seat) to the hospital. The woman went along with her son.
After getting information from several witnesses, the police officer went to the hospital to give the mother the ticket.
The juvenile son in the passenger seat got the ticket. Not the mother.
I called the police and repeatedly told them they ticketed the wrong person.
So a witness and I head to juvenile court. We sit for an hour and an attorney walks out and asks who was driving. I say the mother was. We never have to enter the court room.
So then we go to municipal court, this time for the mother. In municipal court, the attorney for the defendant asks for a continuance, which the judge grants.
So we go to court a third time, this time with a second witness - a photographer who happened to be at the scene of the accident. This photographer lives down the street and has done work for the police. By this time, the mother is rumored to be denying she was ever there. Fortunately, the photographer has her in numerous pictures at the scene of the accident.
The defendant's attorney asks for another continuous. The son isn't in court because he wasn't served notice. He's a juvenile and lives in the same house as the mother, who is sitting in court in front of us. The mother claims she doesn't know where the son is.
After exasperation from everyone, the judge decides to take testimony from everyone present.
The defendant was found guilty of the traffic violation (duh), but not guilty of obstruction of justice. The police officer blew the testimony with conflicting and confusing information.
The photographer witness later told me the police officer had once dated the defendant's sister.
Oh. Did I tell you the mother was driving her aunt's car, and the aunt didn't feel it necessary to carry insurance? The aunt was never cited for lack of insurance (those laws are toothless anyway).
Fun times. Fun times.
